In response to the Unleashing American Innovators Act (UAIA) of 2022, the United States Patent and Trademark Office (USPTO) conducted a detailed study on its fee structure, particularly focusing on the impact on small and micro entities.
The study, handed over to the US Congress and led by Prof. Gaétan de Rassenfosse and Prof. Adam B. Jaffe (Brandeis University) provides critical insights into the current fee structure and its potential reforms. The findings address key questions such as whether current fees inhibit patent filings, the alignment of examination fees with costs, and the need for adjustments in standard and maintenance fees.
The authors conclude that the current USPTO fee structure is effective, while suggesting targeted improvements to enhance its sustainability and impact.
